Massachusetts divorce legal matters
can be categorized as follows:
The Massachusetts
divorce is the legal dissolution of the
marriage. The court is involved in the first place because
the marriage is a legal contract that you are seeking to
dissolve. As a practical matter, if one party wants the
divorce, it will happen.
The Massachusetts divorce court has the authority to divide
the assets of the marriage - cash, stocks, real estate,
closely held businesses, paintings, pension plans,
furniture, etc. Who gets what?
Similar in principle to the division of assets is the
division of debts. The Massachusetts divorce court can
decide about the debts. Who is liable for what during
divorce proceedings.
The Massachusetts divorce court can decide about the
alimony. The court can order one spouse to contribute to the
future support of the other. For example, the wife can be
ordered to pay $500 a week to the husband and vice versa.
Where children are involved, there will be child support
ordered by Massachusetts divorce court. If the parties
together earn under $100,000, this support will be pursuant
to the guidelines for child support
Physical custody means with whom will the child(ren) live?
Legal custody means that what rights will each parent have
with respect to the child's medical, educational and other
needs.
Visitation is often called a "parenting schedule," this
details how often and under what conditions the
non-custodial parent will visit with his/her children). Grandparents
also have rights which may be the subject of court action.
A modification is an action whereby one party seeks
to change an existing agreement and/or court order. This is
necessary many times when financial circumstances have
changed.
The best course is to avoid a trial. Trials are expensive
and their outcomes are difficult to predict. With the
assistance of counsel, parties are usually well advised to
come to a written agreement between the parties.
